SMS & Mobile Messaging Terms
These SMS & Mobile Messaging Terms ("Messaging Terms") describe how Smith Family Realty Texas uses text messaging and other mobile messaging channels for recruiting and brokerage-related communications. Please read these Messaging Terms carefully.
By enrolling in, or otherwise consenting to, our SMS or mobile messaging program, you agree to these Messaging Terms, which are in addition to any other terms or agreements that apply to your relationship with Smith Family Realty Texas.
Program Operator and Scope
The SMS and mobile messaging program (the "Program") is operated by Smith Family Realty Texas, a Texas real estate brokerage. All messages are sent by or on behalf of Smith Family Realty Texas in connection with its brokerage and recruiting activities.
The Program is used only for recruiting communications (for example, messages to current or prospective real estate agents and staff) and brokerage-related operational communications (for example, transaction-related updates, appointment confirmations, and similar non-marketing messages). It is not used for consumer marketing or promotional campaigns.
Program Details and Message Types
The Program may include, without limitation, the following types of messages, depending on your relationship with Smith Family Realty Texas and your communication preferences:
- Recruiting-related messages, including initial outreach, follow-up, and scheduling of informational calls or meetings for prospective or current real estate agents and staff.
- Brokerage-related operational messages, including transaction coordination updates, reminders, appointment confirmations or changes, document or deadline notifications, and similar service or support communications.
- Service and account notifications related to your role or relationship with Smith Family Realty Texas, such as changes to internal processes, compliance notices, or similar informational updates.
Message frequency will vary based on your interactions with Smith Family Realty Texas and active brokerage or recruiting activities, but you can generally expect no more than a limited number of messages per week. Frequency may temporarily increase during periods of active communication, such as during an ongoing transaction, onboarding, or time-sensitive coordination.
Cost and Carrier Disclosures
Smith Family Realty Texas does not charge a separate fee for sending or receiving SMS or mobile messages under the Program. However, message and data rates may apply to each SMS or MMS message sent or received, as imposed by your mobile carrier under your existing mobile plan.
Smith Family Realty Texas is not responsible for any charges billed to you by your mobile carrier. You are solely responsible for any charges related to SMS, MMS, or data usage and for confirming the applicable costs with your mobile carrier before participating in the Program.
Consent, Opt-In, and Eligibility
Participation in the Program requires your prior express consent, which may be obtained through written, electronic, or other documented means that are compliant with applicable law and industry rules, including A2P 10DLC requirements, the Telephone Consumer Protection Act (TCPA), and carrier guidelines where applicable.
By providing your mobile phone number to Smith Family Realty Texas and affirmatively consenting to receive SMS or mobile messages, you represent that you are the current subscriber or authorized user of the mobile number provided and that you are at least 18 years of age or the age of majority in your jurisdiction.
Your consent to receive SMS or mobile messages is not a condition of working with Smith Family Realty Texas, applying for any role, or participating in any brokerage relationship. Where applicable, you may choose alternative communication methods instead of SMS or mobile messaging.
Opt-Out and Help Instructions
You may opt out of the Program at any time. To stop receiving SMS or mobile messages from Smith Family Realty Texas for a particular messaging stream, reply with the single keyword "STOP" to any message you receive from that stream. After you send "STOP," we may send a single confirmation message to confirm that you have been unsubscribed for that specific communication category.
If you subscribe to more than one type of messaging (for example, recruiting versus brokerage operational updates), opting out of one messaging stream may not automatically unsubscribe you from all other streams. In that case, you may need to send a separate "STOP" message for each stream or contact us using another method to manage your preferences.

Data, Privacy, and Security
Smith Family Realty Texas collects and maintains certain information in connection with the Program, which may include your name, mobile phone number, message content, time and date of messages, and related technical details needed to deliver and manage communications and comply with legal and carrier requirements.
We use this information to operate and administer the Program, maintain records of your consent and communication preferences, improve our internal processes, and comply with applicable laws, regulations, and industry standards, including A2P 10DLC registration and monitoring obligations where applicable.

While Smith Family Realty Texas takes reasonable steps to safeguard the security of information used in the Program, wireless communication can never be guaranteed to be completely secure or error-free. You should take this into account before deciding to share sensitive or confidential information by SMS or mobile message.
User Responsibilities and Mobile Number Changes
You agree to provide accurate and current mobile contact information to Smith Family Realty Texas and to promptly notify us if your mobile number changes, is reassigned, or is no longer under your control. Continuing to use a number you no longer control in connection with the Program may result in messages being sent to the wrong recipient, which may violate applicable law and carrier rules.
If you share your mobile device with others, you are responsible for ensuring that only authorized individuals access the Program and that any person with access to the device is aware of and agrees to these Messaging Terms, as well as to any other applicable terms and disclosures from Smith Family Realty Texas.
A2P 10DLC and Carrier Compliance
Where applicable, Smith Family Realty Texas uses registered application-to-person (A2P) 10-digit long code (10DLC) messaging or other compliant messaging channels to deliver Program messages in accordance with carrier requirements and industry standards. Program messages are limited to recruiting and brokerage-related operational content as described in these Messaging Terms.
Mobile carriers do not guarantee the delivery of SMS or MMS messages and are not responsible for delayed or undelivered messages. Smith Family Realty Texas is not liable for any delays in the receipt of messages or for messages that are blocked or filtered by your carrier or device, provided we have transmitted the message in accordance with these Messaging Terms and applicable rules.
Disclaimers and Limitation of Liability
Program messages are provided for informational and operational purposes in connection with Smith Family Realty Texas brokerage and recruiting activities. Messages are not intended to provide legal, tax, financial, or other professional advice, and you should not rely on SMS or mobile messages as a substitute for appropriate professional guidance or written brokerage documents.
To the fullest extent permitted by applicable law, Smith Family Realty Texas and its owners, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or relating to the Program or these Messaging Terms, including any delays, failures, or inaccuracies in message delivery, even if advised of the possibility of such damages.
Nothing in these Messaging Terms is intended to limit liability that cannot be excluded or limited under applicable law. Certain limitations and exclusions may not apply to you if prohibited by the laws of your state or jurisdiction.
Changes, Contact Information, and Governing Law
Smith Family Realty Texas may update or modify these Messaging Terms from time to time to reflect changes in our practices, legal requirements, or industry standards. Any material changes will be effective when posted on this page or otherwise communicated to you as required by applicable law. Your continued participation in the Program after any changes become effective constitutes your acceptance of the updated Messaging Terms.

Subject to any mandatory provisions of applicable law, you agree that any legal action or proceeding relating to these Messaging Terms or the Program will be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of such courts.
